Insured and Self-Insured Coverage, Subrogation and Indemnification Litigation

Major issues particularly in the construction and transportation arenas concern contractual risk transfer such as indemnification and insurance requirements required of an employer as to its customers. Our Civil Litigation Department headed by Gregory G. Vacala, who actually litigated the Virginia Surety case from the trial through the Supreme Court focuses on a daily basis in subrogation and indemnification litigation ranging from protection of employer’s liens whether insured or self-insured in third party litigation and defending employers for claims of indemnification and failure to procure insurance.

The department’s goal is to maximize a self-insured or insured’s recovery of benefits paid pursuant to the Illinois Workers’ Compensation Act while minimizing any erosion of subrogation recovery through the effective defense of employer’s liability claims for contribution as well as aggressive defense of any lien adjudication in such matters in which the employer is not a party for contribution.
